Terms of Use

These Terms of Use ("Terms") govern access to and use of the Black Coral Aquatics intranet application (the "App") operated by Black Coral Aquatics, LLC ("BCA"). By accessing or using the App, you agree to these Terms.

1. Authorized Use

The App is for approved business use by authorized personnel and approved users only. You agree to use the App only for lawful and authorized business purposes.

2. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify BCA immediately of unauthorized access or suspected compromise.

3. Data Accuracy

You agree to enter and maintain accurate information in the App, including financial, project, customer, and operational records, and to promptly correct known inaccuracies.

4. Prohibited Conduct

You may not misuse the App, including by attempting unauthorized access, reverse engineering, data scraping, service disruption, or any conduct that threatens confidentiality, integrity, or availability of App data or systems.

5. Intellectual Property

All App content, source code, workflows, templates, and records are owned by BCA or its licensors and are protected by intellectual property laws. See the Intellectual Property Notice for additional terms.

6. Confidentiality

Information in the App may include confidential, proprietary, or sensitive business data. You must not disclose such information except as required to perform authorized duties or as required by law.

7. Suspension or Termination

BCA may suspend or terminate access at any time for violations of these Terms, security concerns, policy violations, or operational reasons.

8. Disclaimer

The App is provided on an "as is" and "as available" basis. BCA does not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the fullest extent permitted by law, BCA will not be liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the App.

10. Governing Law

These Terms are governed by the laws of the State of Oregon. Venue for disputes shall be in courts of competent jurisdiction located in Oregon.
